Communication Terms and Conditions

Sumnicht Eye Care – Terms and Conditions


Effective Date: September 8, 2025


By opting in to receive SMS text messages from Sumnicht Eye Care, PLLC (“Sumnicht Eye Care,” “we,” “us,” or “our”), you agree to the following Terms and Conditions (“Terms”). Please read them carefully before participating in our messaging program.


1. SMS Messaging Service


By providing your mobile phone number and opting in using the word EYE, you consent to receive SMS text messages from Sumnicht Eye Care through our messaging service provider, SolutionReach, for purposes including (but not limited to): appointment reminders and confirmations, marketing and promotional messages, and general communication or updates related to our services. Message and data rates may apply depending on your mobile carrier’s terms. Participation is not a condition of receiving services from Sumnicht Eye Care.


2. Message Frequency


Message frequency may vary based on your interaction with our practice. You may receive 1-2 messages per month. Sumnicht Eye Care reserves the right to increase or decrease the number of messages sent at any time. Carriers are not liable for delayed or undelivered messages.


3. Message and Data Rates


Standard message and data rates may apply to each text message sent or received, as provided in your mobile telephone service plan. Please contact your wireless carrier for details regarding your plan and applicable fees.


4. Privacy Policy


Your privacy is important to us. All personal information collected through our SMS program will be handled in accordance with our Messaging Privacy Policy and our general Practice Privacy Policy, which comply with HIPAA and 10DLC privacy requirements.


We collect and use your personal information, such as your phone number, solely for purposes directly related to your account, including sending SMS messages regarding your account activity. Your information will not be shared with third parties except as required by law. Your data will not be transferred to external organizations.


5. Cancellation / Opt-Out Instructions


You may opt out of receiving SMS messages from Sumnicht Eye Care at any time by replying STOP to any text message we send. After opting out, you will receive one final confirmation message confirming that your request has been processed. No further messages will be sent unless you re-enroll.

7. Liability Disclaimer


Sumnicht Eye Care is not responsible for charges or fees incurred from your mobile carrier, delays, errors, or undelivered messages caused by mobile networks, carriers, or third-party providers, or unauthorized access or misuse of your mobile device. Participation in the SMS program is at your own discretion and risk.


8. Modifications


Sumnicht Eye Care reserves the right to modify these Terms at any time. Updates will be reflected by the Effective Date above. Continued participation in our SMS program after changes are posted constitutes your acceptance of the revised Terms.

This Terms and Conditions statement aligns with CTIA, TCPA, and 10DLC messaging standards, ensuring clear consent, opt-out mechanisms, and transparency in message frequency, purpose, and data handling.

By texting EYE to 425-778-2500, you agree to receive SMS messages from Sumnicht Eye Care. Message frequency may vary, but you can expect an average of 1–2 messages per month. These messages may include appointment reminders, important updates, or patient care information.
